Dog Training Services Terms & Conditions

Please read these Dog Training Services Terms & Conditions (“Dog Training Terms”) carefully. By enrolling, purchasing, scheduling or otherwise participating in any dog training services from Star Dog Training, LLC (“Star Dog Training”, “Trainer”, “we”, “us”, or “our”), you agree to these Dog Training Terms, in addition to our Dog Training Services Agreement (as defined below), our General Terms & Conditions and our Privacy Policy, which are incorporated herein by reference.

  1. Defined Terms

    “Client” shall mean you, the individual(s) enrolling, purchasing, scheduling or otherwise participating in any dog training services from Star Dog Training.

    “Dog” shall mean the dog/dogs in which you have enrolled, purchased, scheduled or otherwise plan to participate in any dog training services from Star Dog Training.

    “Dog Training Services Agreement” shall mean the written and executed agreement between you and Star Dog Training. This agreement shall be provided to you separately by Star Dog Training and must be executed prior to starting any dog training services with Star Dog Training, unless otherwise explicitly agreed upon with Star Dog Training.

    “Services” shall mean any kind of dog training services, including any content, information or advice relating thereto, that you enroll, purchase, schedule or otherwise participate in from Star Dog Training.

    “Session(s)” shall mean any and all planned or scheduled date, time and/or place to meet Trainer for any dog training services purchased from Star Dog Training by you.

  2. Ownership

    Client acknowledges and agrees that he/she is the rightful owner and handler of the Dog and assumes any and all responsibility and liability for and of the Dog, including, but not limited to the proper care, any and all liability, medical, financial and legal responsibilities as commonly understood of pet ownership.

  3. Vaccination Requirements

    Dog must be up-to-date and current with all vaccinations in order to participate in the Services and such vaccination records shall promptly be provided to Trainer upon request. Titer’s test results are accepted in place of vaccination records.

  4. Illnesses

    Dog shall not participate in the Services when showing signs of injury, medical condition or illness such as, but not limited to, parasites, kennel cough, fleas or other contagious symptoms and Client shall notify Trainer immediately of any such symptoms. If any injury, medical condition, or illness is recognized by Trainer before, during or after any Session, Trainer will immediately inform Client and discuss further care, which may result in an immediate stoppage in the Services until the injury, medical condition or illness has been resolved and/or treated and proof of care is provided by Client to Trainer.

  5. Equipment/Tools

    All Dog training equipment and tools must be approved by Trainer for safety purposes and Trainer may recommend additional training equipment and tools as part of participation in the Services, to which Client agrees to obtain at Client’s expense.

  6. Leash Requirements

    Dog must always be leashed on a five-to-six-foot (5’-6’) leash during any and all Sessions provided as part of the Services, unless otherwise explicitly instructed by Trainer. Client may not use retractable or extra-long (ten foot or more (10’+)) leashes, unless otherwise explicitly instructed by Trainer.

  7. Age Requirements

    Client is at least eighteen (18) years of age. In the event Client wishes for his/her child(ren) under the age of eighteen (18) to participate in the Services, Client, as child(ren)’s parent or guardian, must (a) notify Trainer immediately; and, (b) sign a release form before Client’s child(ren) may participate in any Services.

  8. Release of Liability

    Client forever releases and holds harmless Star Dog Training and its officers, trainers, suppliers, employees, volunteers and agents from any and all claims or liability of loss, harm, damage, injury, accident, cost or expenses resulting from any actions by or to the Dog or Client before, during or after any Session, during or after the Services are complete and for all time.

  9. No Guarantee

    Client acknowledges and agrees that Trainer cannot and does not represent, warrant, guarantee or promise results of the Services, including, but not limited to, that the Dog will not exhibit dangerous or other behavioral or medical concerns before, during or after any Session, during or after the Services are complete or for all time, or that the results of Services will last for any specific amount of time.

  10. Right of Refusal to Provide Services

    Trainer reserves the right to refuse Services to Client for any reason at any time at Trainer’s sole and absolute discretion.

  11. Recording Permission

    From time to time, Trainer may wish to take photographs and/or recordings of Sessions that include images, video, audio and other likenesses of Client and Dog. By participating in the Services, Client authorizes and grants Trainer permission to take and use such photographs and/or recordings for any and all purposes at Trainer’s discretion and in perpetuity, unless Client notifies Trainer otherwise in writing.

  12. Services and Fees

    Trainer offers different types of Services options, which Trainer will provide to or discuss with Client. Except as otherwise provided herein, Services options may be selected at Client’s discretion. Additional details regarding Services and respective fees for Services shall be provided to Client upon request and (a) are non-refundable; (b) are subject to the Cancellation Policy below; and, (c) must be paid by Client to Trainer as outlined below, unless alternate payment arrangements have been agreed upon and approved by Trainer:

    • Initial Evaluation Session: The Initial Evaluation Session is up to two (2) hours long. The non-refundable fee(s) for the Initial Evaluation Session must be paid in full upon booking and/or otherwise prior to the scheduled Session thereof. ALL NEW CLIENTS AND DOGS ARE REQUIRED TO PARTICIPATE IN AN INITIAL EVALUATION SESSION WITH TRAINER BEFORE ENROLLING, PURCHASING, SCHEDULING OR OTHERWISE PARTICIPATING IN ANY OTHER SERVICES.
    • Private Sessions: Private Sessions are one (1) hour long and any amount of time over the allotted 1-hour for the scheduled Private Session will be charged to Client at Trainer’s hourly rate and due at the time of such extended Private Session. Fifty percent (50%) of the non-refundable fee(s) for Private Sessions must be paid upon booking and/or otherwise prior to the scheduled Session thereof. The remaining 50% of the fee(s) for Private Sessions is due at the time of the scheduled Session.
    • Packages: Packages include a set number of Private Sessions. Each Session is one (1) hour long for one Dog or one and a half (1.5) hours long for two Dogs, depending on which Package Client selects. Any amount of time over the allotted time given for a scheduled Private Session in the Package will be charged to Client at Trainer’s hourly rate and due at the time of such extended Private Session. The non-refundable fee(s) for any Package must be paid either in (a) full upon booking and/or otherwise prior to the first scheduled Private Session of the Package; or, (b) two (2) installments, with the first (1st) installment (fifty percent (50%)) of the Package fee(s)) paid upon booking and/or otherwise prior to the first scheduled Private Session of the Package and the second (2nd) installment paid mid-way through the Package. In the event that Client chooses to pay in 2 installments, the 2nd installment of the Package fee(s) must be paid as follows: (a) for a Package of four (4) Private Sessions, the 2nd installment of the Package fee is due on the third (3rd) scheduled Private Session of the Package; or, (b) for a Package of six (6) Private Sessions, the 2nd installment of the Package fee(s) is due on the fourth (4th) scheduled Private Session of the package.
    • Puppy Foundations Class: Puppy Foundations Class includes six (6) Sessions in a public and group setting, as scheduled by Trainer, and is meant for dogs up to one (1) year old. Puppy Foundations Classes do not require an Initial Evaluation Session. Each Session in the Puppy Foundations Class is one (1) hour long. Upon completion of all Sessions in the Puppy Foundations Class, Client and Dog may test for the AKC S.T.A.R. Certification. The non-refundable fee(s) for Puppy Foundations Class must be paid in full upon registration.
    • Short Takes Class: Short Takes Class includes four (4) Sessions in a public and group setting, as scheduled by Trainer. Short Takes Class is only available to existing Clients. Each Session in Short Takes Class is one (1) hour long. The non-refundable fee(s) for Short Takes Class must be paid in full upon registration.
    • Group Class: Group Classes include one (1) Session in a public and group setting, as scheduled by Trainer. Group Classes are only available to existing Clients. Group Classes are one and a half (1.5) hours long. The non-refundable fee(s) for Group Classes is due in full on the day of the scheduled Group Class.
  13. Goals, Roles and Expectations

    Trainer and Client will discuss any and all concerns, desired outcomes, skills, commands or otherwise desired goals for the Client and the Dog (collectively, “Goals”) and Trainer may recommend Services options that may be most likely to aid in achieving such agreed upon Goals. However, Services options are at Client’s discretion, except for the Initial Evaluation Session.

    The role of Trainer is to spend any and all Sessions, regardless of the Services option selected, teaching both Dog and Client the skills and/or commands geared towards achieving the agreed upon Goals. It is Trainer’s expectation that Client shall devote a minimum of twenty (20) minutes daily to practicing the skills and/or commands, which will be built upon in subsequent Sessions.

    Trainer will provide Client with assignments after each Session and follow-up emails with instructions for such assignments. A Client’s commitment to the assignments will directly corelate with achieving the agreed upon Goals.

  14. Cancellation Policy

    If Client must cancel or reschedule a Session with Trainer, the following Cancellation Policy will apply:

    • Any cancellation of an Initial Evaluation Session by Client at any time shall result in Client’s forfeit of the Session and any and all fees paid to Trainer for such Session. Client will be required to rebook Session, including paying the non-refundable fee(s) for such rebooked Session.
    • Any cancellation or no-show by Client on the morning of a Group Class shall result in Client’s forfeit of the Session and any and all fees due for such Session must be promptly paid to Trainer.
    • If Client notifies Trainer at least forty-eight (48) hours prior to the Session1, Client may simply reschedule the Session with Trainer without penalty.
    • If Client notifies Trainer less than 48 hours prior to the Session1, Client forfeits the Session and any and all fees paid to Trainer for such Session. Client will be required to rebook Services, including paying the non-refundable fee(s) for such Services.
    • If Client is unable to attend any Session of the Puppy Foundations or Short Takes, Client forfeits the Session and any and all fees paid to Trainer for such Services regardless of how much advance notice is given to Trainer. For clarity, Client may continue to attend the remaining Sessions of the Puppy Foundations or Short Takes, but under no circumstances will Client be entitled to a prorated refund of fees for any missed Sessions thereof.
    • If Client does not provide Trainer with any prior notification to cancel or reschedule a Session and does not show up for the Session (a “no-show”) and/or repeatedly cancels and/or reschedules Sessions (two (2) or more), it will result in any one or more of the following: (a) Client forfeits any and all Services fee(s) paid to Trainer; (b) a $25 rebooking fee will apply in order to re-book, re-enroll or reschedule any Services; (c) all Services fee(s) must be paid in full in advance in order for Client to participate in any and all future Services from Star Dog Training; and/or (d) the suspension or termination of Services from Star Dog Training.

    1Not applicable for cancellations by Client of Initial Evaluation Session or Group Class. Please refer to the respective bullets relating to cancellations by Client of such Session(s).

  15. Force Majeure

    Neither party shall be liable to the other for delay or failure to perform its obligations as a result of circumstances beyond its reasonable control, including, but not limited to: any acts of God; floods; fires; earthquakes; war; acts of terrorism; riots; civil unrest; pandemics; government legislation, acts, orders or regulations; interruption or delay in transportation; or unusually severe or inclement weather (“Force Majeure Event”). Should a Force Majeure Event occur, each party’s obligations hereunder shall be suspended whilst the Force Majeure Event continues. Should a Force Majeure Event continue for more than ninety (90) consecutive days, either party may terminate the Services upon written notice to the other party without prejudice or further obligations.
